While harvesting of trees or other crops from areas that are wetlands is often allowed without permits, filling, excavating, flooding or draining these areas requires permits and should not be done until authorized by the Department of Environmental Protection and/or the Army Corps of Engineers. See the Forms and Guidance page for links to several fact sheets that describe wetlands. It should be noted that while several published indicators exist to assist in determining if wetlands are likely on a site, only an onsite investigation by someone trained in wetland identification can determine with any certainty if wetlands are present on a site. Ponds Not all ponds require permitting, but many do, so please educate yourself before constructing, altering, or draining a pond.
